Il reato di “turbatio sacrorum”, di cui all’art. 405 c.p., può essere
perfezionato da due condotte antigiuridiche: l’impedimento della
funzione, consistente nell’ostacolare l’inizio o l’esercizio della
stessa fino a determinarne la cessazione, oppure la turbativa della
funzione, che si verifica quando il suo svolgimento non avviene in
modo regolare. Nel caso di specie la Corte ha ravvisato il suddetto
reato nella turbativa causata dal comportamento dell’imputato, che
aveva, nel corso della celebrazione della Messa, coinvolto e
disturbato molti fedeli dal loro raccoglimento.
