Poiché nell’ampia sfera delle libertà di pensiero e di culto
costituzionalmente protette e garantite nei confronti di tutti
indistintamente deve essere compresa qualunque manifestazione verbale
e scritta che comunque contrasti al pensiero religioso, salvo i limiti
riguardanti il buon costume previsti dalla stessa Costituzione, è
logico concludere che anche le espressioni con contenuti oltraggiosi o
irriverenti o che abbiano l’idoneità a vilipendere una qualunque
religione vanno inclusi nell’ambito dell’estrinsecazione della
libertà di pensiero nel campo religioso. Pertanto, nella fattispecie,
malgrado la sussistenza e la pubblicità del reato di bestemmia e la
sussistenza nella sua entità materiale del reato di vilipendio alla
religione dello Stato, deve applicarsi l’esimente prevista
dall’art. 51 cod. pen. per avere l’imputato agito nell’esercizio
di un diritto garantito dalla Costituzione.
