L’ordinanza ministeriale 14 maggio 1999 n. 128, recante norme per lo
svolgimento degli scrutini e degli esami di maturità, stabilisce che
gli insegnanti di religione cattolica partecipano “a pieno titolo”
all’attribuzione del credito scolastico. La disposizione non comporta
una discriminazione, nè lede il diritto di scegliere liberamente se
avvalersi dell’IRC. Infatti, poichè si può ottenere credito
scolastico anche da altre attività (attività alternative
all’insegnamento della religione, oppure attività extra-scolastiche),
la valutazione degli insegnanti di religione ai fini dell’attribuzione
del credito scolastico non incide negativamente sulla condizione di
quegli studenti che, all’inizio dell’anno, liberamente e senza
alcuna conseguenza ai fini della carriera scolastica, abbiano ritenuto
di scegliere di non avvalersi della religione cattolica e di non
svolgere altra attività alternativa.
