Il divieto di discriminazione religiosa (ex artt. 9 e 14 CEDU) è
violato non solo quando viene applicato un trattamento differenziato a
situazioni analoghe, ma anche quando trattamenti uguali vengono
applicati a situazioni diverse. Se gli Stati non prevedono trattamenti
diversificati nei confronti di persone che si trovano in situazioni
differenti, violano il diritto degli individui a non essere
discriminati nell’esercizio delle libertà garantite dalla CEDU. Nel
caso di specie, ad un Testimone di Geova, precedentemente condannato
per aver rifiutato di indossare l’uniforme militare, era stata negata
l’iscrizione al registro degli esperti contabili. Ad un soggetto
condannato per motivi religiosi era stato, cioè, applicato il
medesimo trattamento nel quale incorrono coloro che siano stati
condannati per altri reati. È dunque illegittima la norma che non
prevede un’adeguata eccezione per chi abbia riportato condanne penali
in ragione del credo religioso.
