Le restrizioni alla circolazione di pubblicazioni ispirate da odio
razziale e religioso non costituiscono una violazione della libertà
di espressione ex art. 10 CEDU, che può essere limitata per legge,
allo scopo di proteggere la libertà altrui nel contesto di una
società democratica. Nel caso di specie, l’autore e gli editori di
un libro intitolato “La colonizzazione dell’Europa” erano stati
condannati dalle autorità giurisdizionali francesi per il reato di
incitamento all’odio razziale. Secondo i giudici nazionali, infatti,
il libro offre una rappresentazione del rapporto tra cultura
occidentale e cultura islamica ispirata all’odio etnico. La Corte di
Strasburgo conferma la lettura delle Corti francesi, rintracciando
nell’opera incriminata i caratteri dell’incitamento all’odio ed
alla violenza (ad es. il ricorso a termini militari, la
caratterizzazione delle comunità islamiche europee come un
“nemico”, l’incitamento ad una “guerra di riconquista”).
