Tra i tentativi di salvare le tradizioni inglesi e scozzesi sulla
caccia (dopo che determinate pratiche, in primis la famosissima caccia
alla volpe, sono state vietate da alcune recenti leggi sulla
protezione degli animali), v’è stato chi ha equiparato l’attività
venatoria ad una vera e propria credenza religiosa. Appellandosi agli
articoli 8, 9, 10, 11 e 14 della CEDU, i ricorrenti hanno sostenuto
che l’averli privati della possibilità di andare a caccia secondo le
modalità solitamente praticate avrebbe integrato una violazione sia
del diritto ad avere e praticare una credenza (in particolare: le
“convinzioni” su come esercitare la caccia; le pratiche svolte, ad es.
l’indossare gli abiti tradizionali, e così via, tutti aspetti che
secondo i ricorrenti sono riconducibili ad un “non-religious belief”),
sia del diritto alla vita privata e familiare (ex art. 8 CEDU), ovvero
del diritto ad esprimere le caratteristiche di un particolare gruppo
“culturale”, nonché del diritto ad associarsi liberamente per
perseguire le finalità della caccia. La House of Lords ha deciso che
nessuno di questi diritti è stato violato dalle leggi sulla
protezione degli animali: la caccia, infatti, non sarebbe equiparabile
ad una religione, né i cacciatori ad un “gruppo etnico” o culturale
protetto dall’art. 8 CEDU.
