Sentenza 06 settembre 2018, n.Case n. 76/2018

La Corte Suprema indiana ha depenalizzato il reato di
omosessualità, punito da più di centocinquant'anni.
La Corte ha infatti chiarito che gli atti sessuali consensuali tra
adulti in luogo privato non possono essere in alcun modo vietati, in
quanto espressione di una libera scelta individuale. La previsione del
codice penale che ancora incriminava i rapporti omosessuali, quindi,
aveva portata discriminatoria e si poneva in contrasto con i principi
costituzionali.
