Consiglio d'Europa

Le Linee guida sulla personalità giuridca delle comunità
religiose o di credo sono state redatte dall'ODIHR, avvalendosi
dell'assistenza del suo Advisory Panel of Experts on Freedom of
Religion or Belief, approvate dalla Venice Commission già nella
sessione di giugno 2014 e di recente pubblicate ufficialmente a cura
dell'ODIHR. Non si tratta di un documento legally binding
dell'OSCE o del Consiglio d'Europa, ma raccoglie i migliori
standard (dichiarazioni, pareri, sentenze) attinenti alla materia
trattata, al fine di offrire un utile strumento di riferimento per
coloro i quali sono chiamati ad adottare o applicare le pertinenti
legislazioni nazionali. Le Guidelines si articolano in quattro parti:
la prima è dedicata alla libertà di religione o credo,
in generale, ed alle sue possibili limitazioni; la seconda alla
libertà religiosa collettiva; la terza alla libertà
religiosa istituzionale, con particolare riguardo al riconoscimento
della personalità giuridica delle comunità religiose o
di credo; la quarta, infine, alla legislazione di vantaggio
applicabile a tali comunità.
