_L’affaire concerne la suppression totale du droit de visite
accordé à un père au motif que ses convictions religieuses étaient
préjudiciables à l’éducation de son fils. La Cour juge que les
tribunaux hongrois n’ont pas prouvé qu’il était dans
l’intérêt supérieur de l’enfant de voir supprimer tous ses
liens avec son père, lequel a dès lors subi une discrimination dans
l’exercice de son droit au respect de sa vie familiale._

diretta ad evitare che l’autorità proceda ad accertamenti in ordine
al reato e alla scoperta dell’autore di esso. Nel caso di specie, il
consiglio di non sporgere denuncia per il delitto di cui all’art.
609 quater da parte di terzi, dato da un parroco alla madre della
vittima, è stato ritenuto dotato di obiettiva valenza elusiva, tenuto
conto che per l’integrazione della fattispecie non è necessaria la
dimostrazione dell’effettivo vantaggio conseguito dal soggetto
favorito, occorrendo solo la prova della oggettiva idoneità della
condotta favoreggiatrice ad intralciare il corso della giustizia.

The Court considered that Ms Gross’ wish to be provided with a
lethal dose of medication allowing her to end her life fell within the
scope of her right to respect for her private life under Article 8.
The Court concluded that Swiss law, while providing the possibility of
obtaining a lethal dose of a drug on medical prescription, did not
provide sufficient guidelines ensuring clarity as to the extent of
this right. There had accordingly been a violation of Article 8 of the
Convention in that respect.
