Cooperation Agreement between the Organization of African Unity (OAU) and the Holy See.

The Organization of African Unity (the “OAU”) and the Holy See, here and after referred to as the “two Parties”.
Whereas the OAU was established with a view to, inter alia, coordinating and intensifying cooperation among its Member States, fostering international cooperation in conformity with its own Charter, the UN Charter and the Universal Declaration on Human Rights, and to that end, to coordinate and harmonize the policies of Member States in certain specific fields;
Whereas the Treaty establishing the African Economic Community stipulates that the objectives of the Community, which constitutes an integral part of the OAU, shall be, inter alia, to promote cooperation in all fields of human endeavour in order to raise the standard of living of African peoples, and maintain and enhance economic stability, foster close and peaceful relations among Member States and contribute to the progress, development and the economic integration of the continent;

Considering that the Holy See has been making significant contributions to the cause of peace, liberty and justice in Africa and that it wishes to improve and strengthen its cooperation with the OAU in these areas;
Hereby agree as follows:
ARTICLE I – Cooperation and Consultations
In order to facilitate the actual realization of the objectives outlined in the basic legal instruments of their respective entities, the OAU and the Holy See shall agree to cooperate closely and to engage in regular consultations on matters of mutual interest such as education, health, human rights and social affairs.
ARTICLE II – Attendance of Meetings/Conferences
1. Subject to procedures in force at the OAU, the Holy See may be invited as observer at meetings organised by the OAU on matters of interest to the Holy See.
2. Subject to procedures in force at the Holy See, the OAU may be invited to participate as observer at meetings organised by the Holy See on matters of interest to the OAU.
ARTICLE III – Organization of Meeting/Conferences
1. The OAU and the Holy See may, if need be, agree to organise joint meetings on matters of mutual interest under their auspices and in conformity with modalities stipulated for each specific case.
2. The modalities of such cooperation and participation shall be subject to agreement between the two Parties.
ARTICLE IV – Joint Activities
On the basis of modalities jointly agreed upon, the OAU and the Holy See may undertake to carry out joint activities with a, view to achieving their common objectives. The said modalities shall specify the type of participation in such joint activities as well as the financial commitments, if any, that might be entered into by each of the two Parties.
ARTICLE V – Technical Cooperation
Within the framework of their cooperation and regular consultations, the OAU and the Holy See shall extend mutual assistance to each other through, inter alia, the exchange of views and technical studies on matters of mutual interest Such cooperation may also include material and financial assistance.
ARTICLE VI – Exchange of Information and Documents
Subject to any agreement or arrangement which may subsequently be adopted with a view to safeguarding the confidentiality of certain documents and information, the OAU and the Holy See may exchange information and documents on matters of mutual interest.
ARTICLE VII – Consultation on Programmes
When one of the two Parties embarks on a programme or activity in an area of interest to the other Party, information may be exchanged on the matter and consultations undertaken with a view to ensuring maximum harmonization of their efforts and avoiding duplication.
ARTICLE VIII – Entry into Force – Amendment – Termination
1. This Agreement shall come into force on the date it is signed by the duly authorized representatives of the two Parties. Each Party shall take the necessary administrative measures required for the implementation of the Agreement.
2. This Agreement may be amended by mutual consent of the two Parties, provided the Party seeking the amendment notifies the other in writing of the proposed amendment. The amendment shall come into force once it is approved by the two Parties.
3. This Agreement may be terminated by either Party which shall then notify the other Party of its decision in writing. The Agreement shall cease to exist ninety (90) days following the date of the notification. However, after the termination of the Agreement, both Parties shall still be bound to honour any outstanding obligations incumbent on them as provided in the Agreement. In witness whereof, the duly authorized representatives of the General Secretariat of the OAU and of the Holy See have hereby signed the present Agreement in two copies, in French and English, both texts being equally authentic.

Accordo di cooperazione fra la Santa Sede e l’Organizzazione dell’Unità Africana (OUA) (19 ottobre 2000)

L’Organizzazione dell’Unità Africana (“OUA”) e la Santa Sede, d’ora in poi denominate “le due parti”;

Considerando che l’OUA è stata creata, fra l’altro, in vista di coordinare e intensificare la cooperazione fra i suoi Stati membri, di favorire la cooperazione internazionale tenendo dovutamente conto della propria Carta costituzionale, della Carta delle Nazioni Unite e della Dichiarazione universale dei diritti dell’uomo, e, a tal fine, di coordinare e armonizzare le politiche degli Stati membri in certi ambiti specifici;
Considerando che il Trattato che istituisce la Comunità Economica Africana stabilisce che gli obiettivi della Comunità, che è una parte integrante dell’OUA, sono, fra gli altri, di promuovere la cooperazione in tutti gli ambiti dell’attività umana in vista di elevare il livello di vita dei popoli africani, di mantenere e rafforzare la stabilità economica, di promuovere relazioni strette e pacifiche fra gli Stati membri e di contribuire al progresso, allo sviluppo e all’integrazione economica del continente;

Considerando l’importante contributo della Santa Sede alla causa della pace, della libertà e della giustizia in Africa, e il suo auspicio di migliorare e rafforzare la propria cooperazione con l’OUA in questi ambiti;
Si sono accordate su quanto segue:
ARTICOLO I – Cooperazione e consultazioni
In vista di facilitare la realizzazione effettiva degli obiettivi definiti negli strumenti giuridici fondamentali delle loro entità rispettive, l’OUA e la Santa Sede si impegnano a cooperare strettamente e a intavolare regolarmente consultazioni sulle questioni di mutuo interesse come l’educazione, la salute, i diritti dell’uomo e gli affari sociali.
ARTICOLO II – Partecipazione alle riunioni/conferenze
1. Condizionatamente alle procedure in vigore presso l’OUA, la Santa Sede può essere invitata in qualità di osservatore alle riunioni organizzate dall’OUA e che trattano di questioni che interessano la Santa Sede.
2. Condizionatamente alle procedure in vigore presso la Santa Sede, l’OUA può essere invitata a partecipare in qualità di osservatore, alle riunioni organizzate dalla Santa Sede e che trattano questioni che interessano l’OUA.
ARTICOLO III – Organizzazione delle riunioni/conferenze
1. L’OUA e la Santa Sede possono, se necessario, accordarsi di organizzare riunioni congiunte su questioni di mutuo interesse sotto i loro auspici e in conformità con le modalità stipulate per ciascun caso specifico.
2. Le modalità di una tale cooperazione e di una tale partecipazione saranno oggetto di un accordo fra le due parti.
ARTICOLO IV – Attività congiunte
Sulla base di modalità approvate di comune accordo, l’OUA e la Santa Sede possono intraprendere attività congiunte allo scopo di realizzare i loro comuni obiettivi. Queste modalità definiscono il tipo di partecipazione a tali attività congiunte, come pure gli impegni finanziari, se occorre, che potrebbe assumersi ciascuna delle due parti.
ARTICOLO V – Cooperazione tecnica
Nel quadro della loro cooperazione e delle loro regolari consultazioni, l’OUA e la Santa Sede si garantiscono scambievolmente l’assistenza grazie, fra l’altro, allo scambio di pareri e di studi tecnici sulle questioni di mutuo interesse. Questa cooperazione può parimenti riguardare un’assistenza materiale e finanziaria.
ARTICOLO VI – Scambio di informazioni e di documenti
Subordinatamente alle disposizioni che potrebbero essere adottate in vista di salvaguardare il carattere confidenziale di certi documenti e informazioni, l’OUA e la Santa Sede possono scambiare informazioni e documenti su questioni riguardanti questioni di mutuo interesse.
ARTICOLO VII – Consultazioni sui programmi
Quando una delle due parti avvia un programma o un’attività in un ambito che interessa l’altra parte, possono a tale scopo essere scambiate delle informazioni e intraprese delle consultazioni a fine di garantire al massimo l’armonizzazione dei loro sforzi e di evitare in tal modo doppioni.
ARTICOLO VIII – Entrata in vigore, emendamento, denuncia
1. Il presente Accordo entra in vigore alla data della sua firma da parte dei rappresentanti debitamente autorizzati dalle due parti. Ogni parte prende le misure amministrative appropriate per garantire l’applicazione del presente Accordo.
2. Il presente Accordo può essere emendato mediante mutuo consenso, a condizione che una delle parti notifichi per iscritto all’altra parte la proposta di emendamento. L’emendamento entra in vigore soltanto se è approvato dalle due parti.
3. Il presente accordo può essere denunciato da una delle parti che notifichi per iscritto la propria decisione all’altra parte. L’Accordo allora cesserà di esistere allo scadere di novanta giorni dopo la data della notifica. Tuttavia, dopo la denuncia dell’Accordo, le due parti sono sempre tenute ad onorare gli obblighi in corso da esse assunti in conformità con le disposizioni dell’Accordo.
In fede di che, i rappresentanti, dovutamente autorizzati dal Segretariato generale dell’OUA e dalla Santa Sede hanno firmato il presente Accordo in due esemplari, in francese e in inglese, i due testi facendo ugualmente fede.

Come è stabilito ivi all’art. VIII n. 1, questo Accordo è entrato in vigore nello stesso giorno in cui è stato firmato, e questo è avvenuto ad Addis Abeba il 19 ottobre dell’anno 2000.
