Explanatory Report I. The European Convention on the Adoption of
Children (revised) was prepared, within the framework of the Council
of Europe, by a Working Party of the Committee of Experts on Family
Law (hereinafter the “CJ FA”), under the authority of the European
Committee on Legal Cooperation (hereinafter the “CDCJ”). Following
its examination and adoption by the Committee of Ministers of the
Council of Europe during its 118th Session (7 May 2008), the
Convention will be opened for signature on [november 2008]. (omissis)

L’Assemblea parlamentare del Consiglio d’Europa richiama l’attenzione
sull’opportunità di predisporre l’adesione dell’Unione europea alla
CEDU – Convenzione europea dei diritti dell’uomo – firmata a Roma nel
1950, al fine di obbligare al rispetto dei diritti ivi sanciti non
solo gli Stati europei, ma anche l’UE nell’esercizio delle sue
competenze. Tale adesione significherebbe garantire ai cittadini
europei mezzi di ricorso effettivi dinanzi la Corte europea dei
diritti dell’uomo (organo della CEDU) anche nel caso di una violazione
dei diritti da parte di un atto comunitario; potrebbe, inoltre,
facilitare una interpretazione più omogenea dei diritti garantiti
dalla CEDU e di quelli riconosciuti dall’ordinamento comunitario,
enucleati soprattutto attraverso la giurisprudenza della Corte di
giustizia.
